The moments after a crash are overwhelming. What you do next can protect both your health and your right to recover. Here are the five steps that matter most.

Get to safety and call the police

Move out of traffic if you can, then call 911. A police report creates an official, neutral record of what happened — one of the most valuable pieces of evidence in any claim. Always report a crash involving injury.

Document the scene and exchange information

Photograph the vehicles, the damage, the road, traffic signs, and your injuries. Exchange names, insurance details, and license plates, and collect contact information from any witnesses. If police do not come to the scene, you may still be required to file a report with the state — in Nevada within 10 days when there is injury or significant property damage, and in Illinois for crashes involving injury, death, or property damage over $1,500.

See a doctor, even if you feel fine

Adrenaline masks pain. Injuries like whiplash, concussions, and internal trauma often surface days later. Getting examined right away protects your health and ties your injuries clearly to the accident — gaps in treatment are the first thing an insurer will use to reduce your claim.

Don't give a recorded statement to the insurance company

The other driver's insurer may call within hours, sounding helpful. Their job is to pay you as little as possible. You are not required to give a recorded statement, and an early, off-the-cuff answer can be used against you later. Politely decline and speak with a lawyer first.

Frequently Asked Questions

How long do I have to file a car accident or injury claim?

In both Nevada and Illinois, you generally have two years from the date of the accident to file a personal injury lawsuit. Property damage claims have a longer window — three years in Nevada and five years in Illinois. These deadlines are strict; miss them and you can lose your right to recover entirely. Because evidence disappears and witnesses' memories fade quickly, it's best to act well before the deadline.

What if the accident was partly my fault?

You may still recover. Both Nevada and Illinois follow a modified comparative negligence rule: your compensation is reduced by your share of the fault, and you're barred from recovering only if you're found more than 50% responsible. So even if you were partly at fault, you likely still have a claim — and insurers often overstate a victim's fault to save money, which is exactly what we push back on.

Should I talk to the insurance company before calling a lawyer?

Be careful. The other driver's insurer may seem friendly, but their goal is to minimize what they pay you. You are not obligated to give a recorded statement, and early statements are frequently used to reduce claims. It costs nothing to speak with us first, and it can protect the value of your case.

What if the driver who hit me had no insurance or fled the scene?

You may still have options. If you carry uninsured or underinsured motorist coverage, it can help cover your losses when the at-fault driver can't. In hit-and-run cases, we work to identify the responsible driver and pursue every available source of recovery. Both Nevada and Illinois require drivers to carry minimum liability coverage of 25/50/20 ($25,000 per person and $50,000 per accident for injuries, $20,000 for property damage), but many carry only the minimum or nothing at all — which is why your own coverage matters.

How much is my personal injury case worth?

Anyone who gives you a firm number before reviewing your case isn't being straight with you. Value depends on the severity of your injuries, your medical costs now and in the future, lost income, the long-term impact on your life, and the available insurance. What does a personal injury lawyer cost?
